Donation conditions

I. Definitions
The term "Terms and Conditions" means these donation conditions in connection with the so-called adoption of pipes within the project to support the restoration of the Strahov organ.
The term "Donor" shall mean a natural or legal person making a donation to the Royal Canonry of Premonstratensians at Strahov, ID No.: 00415090, with its registered office at Strahovské nádvoří 132/1, Hradčany Praha 1 118 00 (hereinafter referred to as the "Canonry").
The term "Gift" means a financial gift made by the Donor.
The term "Web" means the website dedicated to the Strahov organ restoration project located on the domain "www.strahovskevarhany.cz".
The term "Adoption" means the provision of a Donation for the restoration of a particular pipe or pipes of the organ of the Basilica of the Assumption of the Virgin Mary in Strahov, Prague.
The term "Project" refers to the restoration of the Strahov organ in the Basilica of the Assumption of the Virgin Mary in Prague at Strahov, within the framework of which a public collection was announced by the Canons and certified by the Municipality of the Capital City of Prague. Prague under the number MHMP 1470366/2024 (hereinafter referred to as the "Public Collection").
II. Basic Provisions
These Terms and Conditions apply to the provision of Gifts to Kanonia for the Project. By making a Gift, the Donor agrees to these Terms and agrees to be bound by them. If a separate written gift agreement or other written agreement is entered into between the Donor and Kanonia that conflicts with these Terms, such gift agreement or other agreement shall take precedence over these Terms.
III. Provision of the gift
The Donor is entitled to make a Gift to Kanonia in accordance with these Terms and Conditions by making a withdrawal of the specific value of the Gift on the Website, using the payment methods listed on the Website for the Project. This is without prejudice to the possibility of concluding a separate gift agreement between the Donor and Kanonia.
Donations may be made through payment methods located on the Site in the amount of the values listed on the Site or in the aggregate.
In the case of payment via payment systems on the Website, the Donor agrees to the use of remote means of communication.
Unless otherwise agreed between the Donor and Canonia, a gift contract between the Donor and Canonia, the subject of which is the provision of the Gift, is concluded at the moment of sending the payment by the Donor. Costs incurred by the Donor in connection with the provision of the Gift, in particular bank charges, internet connection costs, etc., are borne by the Donor. A confirmation of receipt of the Gift for tax purposes will be sent to the Donor automatically. If the Donor wishes to draw up a separate Gift Agreement, he/she may contact Kanonia. In this case, Kanonia undertakes to send the Donor a draft gift agreement without undue delay.
The provision of a Gift for a specific pipe within the Adoption does not change the ownership rights, nor does any legal claim to such change arise.
IV. Use of the Gift
The Canon is obliged to dispose of the Gift in accordance with the Project's objective. In the event that a Donation is received for a specific Adoption, the Canon is obliged to use the Donation exclusively for this purpose.
V. Privacy Policy
The controller of the Donor's personal data is Kanonie. The Donor acknowledges and agrees that Kanonie, or the designated personal data processor, collects, processes and stores his/her personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "GDPR") for the purpose of presentation on the Website (in the list of Donors) and in commemorative documents on the Project (e.g.), for the internal needs of the Canon in connection with the Project, in particular for issuing certificates, Donor certificates, sending information, documents to the address and electronically, etc, for the purpose of processing annual reports, keeping statistics, etc. The Donor is entitled to request that his/her name and company name not be published in the list of Donors on the Website and memorial documents. In this case, the Canon is obliged not to publish this information.
Under the conditions set out in the GDPR Regulation, the Donor also has the right to request access to his/her personal data from the controller, the right to rectification or erasure of his/her personal data or restriction of its processing, the right to object to the processing of his/her personal data and the right to the portability of his/her personal data. The Donor has the right to withdraw consent to the processing of his/her personal data given to the controller at any time, but this does not apply to the legal obligation to report Donations. However, this does not affect the lawfulness of the processing of personal data prior to such withdrawal of consent. The Donor may withdraw their consent to the processing of personal data in the following manner:
- in writing to the contact e-mail varhany@strahovskyklaster.cz, by data box or to the address of the registered office or;
- in person at the address of the personal data controller's registered office (Kanonie).
Consent under this Article is granted for a period of 15 years from the date of the last donation by the Donor.
VI. Return of the gift, withdrawal from the contract
In the event that it is proven that the funds constituting the object of the Gift have been used in violation of the purpose of the Project, Canonia is obliged to return the Gift upon the Donor's request.
Within 30 days from the date of receipt of the Donation, the Canon is entitled to decide to withdraw from the concluded donation agreement (rejection of the Donation), even without giving any reason, especially if the Donor is a legal entity with an opaque ownership structure. The withdrawal shall take place upon delivery to the Donor (with ex tunc effects). In such a case, Canonie is obliged to return the Gift without undue delay. The Donor shall not be entitled to any interest accrued between the time the Gift is made and its return.
VII. Final Provisions
These Terms and Conditions are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. All disputes arising from these Terms and Conditions, as well as from individual donation contracts concluded under these Terms and Conditions, shall be resolved by the courts of the Czech Republic having jurisdiction in the matter and place.
